Terms of Use

Welcome to NextGig! These Terms of Use govern your access to and use of our platform and services. By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. If you do not accept these terms, you may not access or use our platform or services. We reserve the right to amend these Terms of Use and our Privacy Policy at any time, and it is your responsibility to review them periodically.
1. Definitions

Platform: Any website, application, portal, or software owned and operated by NextGig.

Services: The facilitation of connections between users and third parties, along with any supplementary offerings provided by NextGig.

Personal Data: Information that can identify an individual, such as name, contact details, date of birth, financial information, and any other related information.

Customer: The party that posts job opportunities on the platform.

Worker: The individual who performs services as an independent contractor via the platform. For the purposes of these Terms, an independent contractor is a person engaged by the Customer to provide services on a freelance basis, where the individual is not considered an employee under the Employment Act or other labor laws of Singapore. Workers are responsible for ensuring compliance with all applicable laws, including CPF contributions and tax obligations.

NextGig: The company operating the platform to facilitate connections between Customers and Workers.
2. User Representations
By using our platform, you represent and warrant that:
2.1. You have the legal authority and capacity to agree to these Terms of Use.

2.2. If you are an individual, you are at least 18 years old;

2.3. All information provided by you is accurate, current, and complete, and you agree to promptly update any changes.
​
2.4. You will comply with all applicable laws, regulations, and these Terms of Use.
​
2.5. Content you upload does not infringe on the rights of others, including intellectual property, privacy, and publicity rights.

2.6. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. Unauthorized access or misuse of your account may result in immediate suspension, termination of your account, or other legal actions as deemed necessary by NextGig.

2.7. You will not engage in any activity that disrupts, harms, or interferes with the functionality or security of the platform.

2.8. You acknowledge that misuse of the platform, including fraudulent activity or unauthorized data access, may result in immediate account suspension or termination.

3. User Responsibilities

3.1. Responsibilities of the Worker
3.1.1. The Worker has the duty to:

Provide complete and accurate information to NextGig and the Customer.

Pay all other fees, dues, taxes, CPF, approved schemes, cooperative society fees or deductions and like payments payable by an employee, independent contractor, or a sub-contractor in connection with Shifts performed by the Worker, in cases when any of the aforesaid payments fall due.
3.2. Acceptance & Acknowledgement of Shift

Shift Application: The Worker can view a Job Post created by a Customer via the NextGig mobile application and is able to read and agree to all the conditions stipulated in the Job Post. The Worker can apply for the Shift by clicking on the “Apply” button on the Job Post.

Acceptance & Acknowledgement of Shift: The successful Worker will receive a notification via the NextGig mobile application that he or she has been selected by the Customer for the Shift. When the Worker clicks the button “Acknowledge,” the Worker hereby accepts the successful Shift Application for which the Customer has selected him or her.
3.3. Disputes with Customer
In the event of any disputes with the Customer in relation to the Shift, the Worker shall inform NextGig of the matter within 24 hours of such occurrence. NextGig will investigate the cause of the dispute and help to mediate between the Worker and the Customer towards a mutual settlement. In the event that such dispute cannot be resolved, the Customer and the Worker hereby agree to submit such dispute to mediation to be carried out by the Singapore Mediation Centre in accordance with the relevant Mediation Procedure for the time being in force. The Customer and the Worker hereby agree to partake in the mediation and to undertake to abide by any terms of settlement reached.

3.4. Cancellation of Shift
The Worker is able to cancel the Shift that he or she has been selected for, in the event that the Worker is unable to commence or complete the Shift. The Worker shall immediately notify both the Customer and NextGig of such intention to cancel the Shift by updating the selected Shift on the NextGig mobile application. A valid reason must be given for such cancellation. Upon investigating the cause of the cancellation, NextGig reserves the rights and discretion to either provide a poor Rating to the Member or to terminate the Worker from the NextGig platform at any time. In the event that a Shift accepted by a Worker is cancelled by the Worker at any time, the Customer reserves its right and absolute discretion to not pay any remuneration to the Member (even if part of the Shift has been completed) or to pay the Member on a prorated basis depending on the number of hours completed in respect of the Shift.
4. Relationships Between Customers, Workers, and NextGig
4.1. NextGig operates as an independent contractor acting as a referral medium between the Customers and Workers through the Platform. NextGig is neither an employer of the Workers nor an employee of the Customers.
4.2. The Customer acknowledges that the Worker is an independent contractor of the Customer who is not eligible for employee benefits mandated under the Employment Act Cap. 91.
4.3. The Parties agree that there is no express or implied employment, agency, joint venture or partnership agreement, or other relationship between the Parties arising from the use of the Platform, except that the Parties are all independent contractors under the terms herein.
5. Use of the Platform
Permitted Use: The Platform is intended to facilitate connections between Workers and Customers.
Prohibited Activities: Users may not:

Misrepresent their identity or qualifications.

Use the Platform for illegal or fraudulent activities.

Interfere with the operation of the Platform or attempt to access restricted areas.

Post offensive, defamatory, or harmful content.
6. Fees and Payments
6.1 NextGig charges the Customer a Platform Service Fee. The Service Fee is a fee paid to NextGig for its services, including hosting, administering and providing the Platform. NextGig does not charge the Worker any fees
6.2 Worker Service Fees: We may charge fees for using certain features of the Platform. Fees will be clearly disclosed prior to usage.
6.3 Payment Processing: Payments between Customers and Workers are facilitated through the Platform. We may use third-party payment processors and are not responsible for their actions.
6.4 Taxes: Users are responsible for understanding and fulfilling their tax obligations arising from transactions made via the Platform.
7. Limitations of Liability
NextGig makes no guarantees or representations regarding:

The outcome of job applications, interviews, or hiring processes facilitated by the platform.

The accuracy, reliability, or usefulness of content or advice available through the platform.

The qualifications or credibility of job applicants or employers.

The uninterrupted operation of the platform or the absence of errors, viruses, or other technical issues.

Content provided by third-party users, which is beyond our control and responsibility.

Disputes or violations arising from transactions between users.
Further, NextGig shall not be liable for:

Loss of data, revenue, business opportunities, or reputation.

Indirect or consequential damages resulting from platform usage.

Failures caused by external events, including natural disasters, power outages, or third-party non-performance.
8. Intellectual Property
8.1. All intellectual property rights on the platform, including user-generated content submitted to NextGig, remain the property of NextGig or respective third parties.
8.2. By submitting content, you grant NextGig a non-exclusive, royalty-free license to use, reproduce, and distribute your content.
8.3. NextGig reserves the right to remove or modify any content at its sole discretion.
9. Termination of Access
We reserve the right to suspend or terminate your account without notice if you violate these Terms of Use or engage in any unauthorized or unlawful activity. In cases of account suspension or termination, you may submit an appeal in writing to NextGig within 30 days of receiving notice. The appeal should include a detailed explanation of the circumstances and any supporting evidence. Decisions on appeals will be at the sole discretion of NextGig and are final.
Conditions for reinstatement, if applicable, will be communicated to the user in writing. Unauthorized or unlawful activities include, but are not limited to, fraudulent job postings, misrepresentation of qualifications, harassment, data breaches, and exploitation of the platform for purposes other than those intended. Upon termination, you must cease all use of our platform, and any provisions that, by their nature, should survive termination will remain in effect.
Users whose accounts are terminated for violations may not create new accounts without prior written approval from NextGig.
10. Confidentiality
All non-public information shared by NextGig with you is confidential and should not be disclosed to third parties without prior written consent.
11. Governing Law
These Terms of Use are governed by and construed in accordance with the laws of the Republic of Singapore.
12. Entire Agreement
These Terms of Use, along with our Privacy Policy, constitute the entire agreement between you and NextGig, superseding any prior agreements.
13. Dispute Resolution
Any disputes arising from or related to these Terms of Use will be subject to the non-exclusive jurisdiction of the courts of Singapore.
14. Enforcement and Violations
Violations of these Terms of Use may be addressed under applicable laws, including but not limited to the Computer Misuse Act, Spam Control Act, and Personal Data Protection Act. We reserve the right to pursue legal action for unauthorized use of our platform or services.
We may revise these Terms from time to time. Any changes will be effective upon posting on the Platform. Your continued use of the Platform constitutes your acceptance of the revised Terms.
By using our platform and services, you acknowledge that you have read, understood, and agreed to these Terms of Use.
